LRC fights eviction of Marlboro residents
On Monday next week, the Legal Resources Centre will be in the Gauteng Local Division of the High Court in Johannesburg on behalf of 16 families who are facing eviction in the case, Gerber Goldschmidt Group (SA) (Pty) Ltd v The Occupants of 16 – 2nd Street, Marlboro and Another (Case no. 13/39599).
On 14 October 2019, the occupiers of 16-2nd Street, Marlboro agreed to be evicted on condition that the City of Johannesburg files a report relating to the eligibility of the first respondents (The Occupiers) for the provision of Temporary Emergency Accommodation (TEA) or any other accommodation. The Applicant (the landowner)
agreed and the agreement was made an order of the court. To date, the City of Johannesburg has yet to file a report in compliance with the order.
Despite the City’s non-compliance with the order of the High Court and the current moratorium on evictions due to the national state of disaster, the Applicant has approached the High Court seeking a final eviction order (and the immediate execution thereof) against the Occupiers.
